Contributor license
This license is between you, the contributor, and AVYX GROUP, SASU au capital de 10 €, 60 rue François Ier, 75008 Paris, France, registered under RCS Paris 999 342 033, TVA FR66999342033 (the "Operator"), which publishes the Pilote Autrement brand. It applies to the videos and photos you send through Aviation Contributors (the "Footage").
1. You keep ownership
Submitting Footage transfers no copyright. You remain the owner and may keep using, licensing or selling your Footage, including to others.
2. Submitting does not mean selection or payment
The Operator is free to select or not select any Footage. Submitting guarantees neither selection, publication, credit nor payment.
3. The license you grant
From the moment the Operator selects your Footage, you grant it a non-exclusive license covering:
- Reproduction: copying and storing the Footage on any medium needed to run the program.
- Representation: showing it to the public by any online means.
- Adaptation: cutting, reframing, slowing down, colour grading, subtitling, translating, adding text, voice-over and music, and combining it with other content.
- Commercial and advertising use: using it in organic content and in paid advertising promoting the Operator's brands, products and services.
Until selection, the Operator may only store and view your Footage to review it.
4. Scope
- Territory: worldwide, because online publication cannot be limited to one country.
- Duration: 10 years from selection, renewable only by written agreement. Content published during that period may stay online afterwards, without new promotion.
- Platforms: the Operator's websites and applications, Instagram, TikTok, Facebook, YouTube, LinkedIn, and comparable online services or their successors, as well as advertising on them. Television, cinema and print are excluded.
- Brands: Pilote Autrement and other programs operated by the same company.
- Sub-licensing: only to service providers and platforms needed to publish the content. The Operator will not resell your Footage as stock footage.
5. Consideration
Unless a written offer says otherwise, this license is granted free of charge, in exchange for the possibility of being featured and credited. A paid license requires a separate offer and your explicit acceptance, under the paid license addendum.
6. Credit and moral rights
You choose how you are credited: by name, by Instagram handle, or not at all. You can change your choice for future publications. Your moral rights are preserved: the Operator will not distort your Footage in a way that harms your honour or reputation. Technical limits of a platform may affect how a credit is displayed.
7. Your statements
You confirm that:
- you filmed or photographed the Footage yourself, or you hold all rights needed to grant this license;
- it infringes no third-party rights, including music, brands, and privacy or image rights;
- you obtained the permissions required for filming and for publication, including those of identifiable people;
- sharing it breaches no duty to your employer, client or authority, and reveals no restricted operational or security information.
If one of these statements proves wrong, the Operator may remove the Footage. Liability between the parties remains subject to applicable law.
8. Restrictions on the Operator
The Operator will not present you as an employee, spokesperson or partner without your agreement, will not suggest that you or your employer endorse a product without your agreement, and will not use your Footage to mock or discredit you.
9. Withdrawal
You may ask at any time, from your contributor space or by writing to contact@aviationcontributors.com, that the Operator stop using a video. Within 30 days of the request, the Operator stops any new use and removes the Footage from its library and from what it controls wherever reasonably possible. It cannot guarantee removal of copies made by third parties. If the Footage was paid for, the withdrawal may lead to reimbursement of the amount received, as set out in the addendum.
10. Termination
The Operator may stop using your Footage at any time. It may also terminate this license if it learns of a rights or safety problem. Your statements in section 7 survive termination.
11. Personal data
Your personal data is handled as described in the privacy notice. That notice is separate from this license.
12. Language, governing law and disputes
The French version prevails where translations differ. This license is governed by French law, without depriving you of any mandatory protection of the country where you reside. The courts with jurisdiction are determined by applicable rules.
